The only thing I can think is the third overflow elbow is supposed to face up and be out of the water so you may hear the water draining down on the other pipe. Regardless if it starts a siphon or not the chances of you cover the overflow of BOTH the first pipes becoming fully blocked seems near impossible. I'm not sure if having the open pipe would prevent the second back up from going full syphon. Just set it up so you can test it and if something goes wrong you can just close off the third whole. If you put a one way valve so that the only time it opens is if the third over flow has water come through it.
I ask questions all the time to get input and then take the input into consideration but in this hobby you have to make your own decisions sometimes. Google bean animal and you can go to his website. I would ask him his opinion and if he gives the no go I would avoid it. I'm no plumbing expert I am just thinking theoretically.
I will agree the only difference between the bean and the Bean and the herbie is the third overflow. Having just a single durso is asking for trouble. If you cover the top and nothing big enough can block the opening you should be fine with just two. As I said I'm no expert and don't want to give you advice on something I am not positive on.
My main concern is if the third pipe coming in which leaves an air opening above the second backup may prevent it from going full syphon. It's like the little airtube that gets blocked when it gets to a certain high depth, you will have an air gap above the second overflow unless you can use some type of spring loaded one way valve Y that would keep the second overflow closed off from the third unless the third needed to be utilized and the water going down would open that gate.
