Botch shipment accountability

Recently I made a substantial purchase of 6 black widow anemones (not on r2r). The seller was in the same state but over a 6hr drive I was losing interest the seller stated they could ship and had successfully shipped out of state and had experience. So this seemed like a win win, I told the seller I would only do shipping of they did standard doa and guaranteed alive arrival. The seller and I reached an agreement on price. So the nems arrive this morning, I open the cardboard box and there is no styro liner/box inside, it was just a cardboard box filled with bubble wrap, and one very small heat pack wrapped in a peice of paper and a few paper towels. The anemones were individually housed on plastic containers that were held in a foam container, the water temperature was 40 degrees. I immediately messaged the seller and they responded its okay they look fine they are from colder water, I said maybe so but certainly not 40 degrees! I stated I would do my best to see if I could save any of them if they were indeed still alive but expected a refund on any/all that didnt make it, the seller stated they arrived alive and would not be issuing a refund of

I'm going to say sorry dude you're out the $$$. Not that I think you are in the wrong, but the seller obviously had no idea how to pack them, so for this rare time they ship, they probably won't absorb the cost. They did technically arrive alive. When you're dying, you're still alive until you're dead.

Hopefully they will just make it, but perhaps suggest splitting the cost for any that die?
 
Also so lets say this was a coral and all but the base was bleached of 2 polyps of the colony are colored does that mean it arrived alive? How can I tell these are alive and not merely preserved in a dead state when they arrived. There is little to no color. I have been in the hobby a while and never had a doa before....never had anything packed so poorly before and as a seller Ive issued my share of refunds and replacements that were exclusively the fault of the shipping service or people not being home. I feel I did everything right as a buyer, sucks to lose what could have been an extra mortgage payment.
 
If you used a credit card, call the company and tell them your story. Ask for a charge back. It is then up to the seller to prove that they met the terms of the sale. If you have your agreement in writing, you may get your money back.

Edit: Who was the seller? If they are reputable, they should send you a replacement or a refund.

You seem like a very patient person.
You got screwed. I'd definitely try to call your CC for a chargeback. It'll be tough since its livestock but at least try.
Also since the guy isn't willing to work with you, I say put him on blast. He obviously doesn't know how to ship but promised he does so he's just lying to get a sale.
I would hate to see anyone else get screwed by this guy.. It's crazy how often it happens with anemones. I see bad nem transactions all the time on the FB groups.

Are you sure you received black widows? If within the first 30 days you have no healthy anemones to verify you received what you purchased then that is something to tell your credit card company. They won't care what temperature of the water, but will care of you didn't receive what you ordered.

Who is this guy? Does he keep his tanks at 30 degrees. Even if they are a deep water variety, wouldn't the drastic temp change stress and kill the anemones?
 
Reviewing all the correspondences. Here the seller describes her shipping methods prior to purchase. She clearly states handwarmers there was 1, but the biggest glaring item is styro container which there wasnt one. It was a done through a local facebook group, a Maine to Maine shipment (I totally would have driven but it was a 6hr drive round trip amd we just had a baby) the seller offered to ship before I even asked stated successful shipments out of state and described her methodology. I did ask for the nems to go in seperate bags in case we lost one ot wouldnt foul the water and bother the rest. The sellers name is Crystal Peters from Bridgton Maine. I have given this person every reasonable oppurtunity and feel there is no need to give her anymore.

Flushed yesterday just balls of mucus. They had decomposed since receiving. The seller stated it was because they were unhappy in the basket and needed to be put in a cave and fed. In all my experieces with them a living nem will adhere open up amd move where it wants.
 
This is ridiculous. They weren’t alive, they were refrigerated. Refridgeration delays decomposition. Since your in the same state you could check to see about filing a small claims case against them at your local magistrate. This is most definitely not “alive” in the generally accepted meaning of the word in the hobby. It means alive and reasonably likely to live given proper care. These were already dead from being refrigerated.
 
That's terrible, sorry your having to deal with something like this. I would also do what others have mentioned, and contact your credit card company for a charge back.
 
The heat pack in the pic is a hand warmer not suitable for shipping imo. I ship with bubble insulation even in below freezing temps but not bubble wrap. In this case I would say it is the sellers fault. The temo swing is obviously what caused them to die.
