eBay clown death

So, ordered a lightning maroon clown from an eBay vendor. Two days later with no word I asked for shipping info, and they responded the fish had jumped out but I could pick another from their website. I did, and it was sent in place of the original. I didn’t take a good look while acclimating because I didn’t have a good view. Once in the tank it hid pretty quick but came out later. I could see it’s cheek looked a little raw or sore or something, but assumed it was a shipping thing. The next morning it was down to the bone and by afternoon the fish was dead. After removing it from the tank I could see threadlike worms on the fish. Have not had a response from the vendor about it, although I reported it several days ago. Now, this is a new 40g cube which I cycled with “Seed” by aquavitro for only two weeks prior. The only other addition was dry rock as I really wanted to start with a sterile tank this time. Pics of left and right side face-on are an hour after adding the fish to the tank, you can see the left side looked rubbed AND something hanging from its neck. Broadside pic is the next morning, and the pic of the fin with a worm crawling across it is after removing it from the tank. Hoping for some clarity on the death, and wether or not a refund is in order.

A refund should be in order unless they have some clause on their listing saying "all sales are final" even then i dont think ebay allows terms like that. Are there any other fish in the tank? I'd worry about infecting another fish
 
they should've never sent a fish like that to anyone. That fish has been infected well before you were thinking about buying him.
 
Thank you for the responses. No other fish, it was the first live addition besides the bacteria.
