Ethical/Liability Question

About 7 weeks ago I ordered a batch of fish from regular Live Aquaria for a newer display and added them to three fish I'd had forever into a tank that was starting with dry rock. The three other fish had been in this specific set up a month, so I'm positive they were healthy.

Day 1, one of the new fish started exhibiting symptoms, everybody was dead of velvet by 10 days later.

I fallowed this set up for 5 weeks and 5 days, and Just added three fish off Divers Den today. These fish appear remarkably healthy. I was going to wait a couple months to be safe, but one specimen isnt particularly common, so i ordered. You can't delay shipments from divers den, and I didnt have time to set up a quarantine, so in they went.

QUESTION: Which party is really liable if they come down with Velvet. Should I claim a refund if they do? Would you?

What is the liklihood of them coming down with velvet? It seems small to me, but possible
 
You would be responsible.

You always take the risk when adding new fish.

I would say the risk of disease is much higher if you aren't buying from a lfs, because you don't get to see them in the tank before you buy and the shipping is going to add more stress.

My LFS is absolute garbage, and disease runs rampant. I would never purchase from them.

I disagree after thinking about this topic more.

LA sent me four fish originally, one of which had velvet, even though the company stresses it's quarantine and treatment procedure online. Of course, in the CA branch, we all know that is garbage (i mean it's petco really now).

I agree that they are not liable for the damages their product caused to my fish, as I chose to introduce them with those fish.

But I have waited only two days shy of the longest time velvet is ever thought to persist in a fallow tank, and thus even by legal definitions, this would probably be considered "reasonable". My apartment is <500 square feet, I spend well over 80 hours a week working. I think that setting up a separate system is not a "reasonable" requirement either.

And actually, given that my fallow period was so long, Is it maybe more likely that any new incidence would once again be from their facility?
