Ok, here is the sitution. I sold someone some chalices recently. I shipped out Monday 1/25/10. One of the bags came open some how (I take the blame for that) and fed ex held it at their location rather than dropping off the package. Due to the buyers work schedule the package was'nt picked up until 7:15pm on the 26th. She then contacted me on the 27th and told me that all of the chalices had some life (some more than others) but did'nt look the best. The maroon was the worst because of the broken bag. The miami hurrican had two seperate eyes and one of them looked perfectly fine. The other eye I could'nt see due to the angle of the picture. Any ways well I got an email today stating that the maroon watermellon and the Miami hurricane died.
My question to you is. More than a week has gone by and the pics that she sent me showed although I admit the maroon did'nt look great, but was still alive and the MH looked fine. Should I replace them? keep in mind that I am in no way trying to bash the buyer, she was great through the process. Thanks

I would replace or refund. I would also submit a claim with FedEx, they should not of held it at their location unless you specified them to. The majority of the time they will deny the claim since it's live animals, but sometimes the approve the claim.
 
sounds good, thanks Mike. Should I replace the MH although it is the one that looked fine in the picture that she sent me?

This one's rather clear cut for me. You should replace or refund. It doesn't surprise me that corals that have been through that much distress died several days later.

I would think it fair and reasonable to replace the maroon. The bag broke contributing to it's demise. The other chalices health was directly affected by how long they were in bags, not your bad. If I were on the buying end of this transaction I would think that was a fair solution. For you and the future I would make it a term of the transaction that if the buyer doesn't take delivery over night that you can't promise anything as to the health of the coral. My two cents and another buck might get you a cup o joe depending on where you go.
 
Yeah a fedex driver will not put anything on their truck that is damaged. Once its on their truck they are held acountable for it. I have had to tell my drivers before that they need to deliver a box because it had live corals or live rock in it and they reply yeah but its wet.. They have a hard time understanding what live coral actually is. Safest bet is to make sure you put a note to del even if wet/leaking on the box next to the lable so the driver can see.
