Ok so I recently acquired a 35 gallon acrylic tank it is 36L x 15W x 16H
I'm having my lfs drill it for me.
My inside hight is 15 5/8
I'm getting the bottom drilled and I'm having a custom overflow box made by synergy reef systems

Synergy reef told me the box is going to be 8"x4"x whatever height I want.

My question is how tall should I get them to make the overflow. Or well actually how tall should I make my water level? I'll let them figure out the overflow part.

I was thinking about having my water level 1" below the top but I am building a canopy and want to hide the water level. So would 1/2" be to little of a gap instead of 1"
 
You can have it go to the top where you want it, that won't be an issue. The depth of the teeth is whats going to give you the flow amount, that and the size of the box.
When building the canopy, you could have the canopy go down a bit more or have it the normal rim of the tank, thats all up to you. Lowering it will allow you to have your water level lower if thats what you want to do, and not have the waterline being seen.

THe guys that are making the Box will make it a normal length.
And on those tanks you can put the level pretty near the top.
