Just got this JBJ picotope out to set up for my daughter....noticed these areas in the seal where the back glass sits on the bottom glass.

Is it still safe to use?

And something else I noticed, there is a large gap between the side glass and the back of the tank (about 1/8"). It is filled in with silicone, but the side and back glass do not meet up.

Inner seal still looks good, i.e. probably safe to use. However, if its brand new I'd exchange it for another for peace of mind personally.

Yes, brand new. Just took it out of the box yesterday. Hopefully JBJ will send me a replacement. Was excited to set this up for my daughter but now it looks like this project is on hold.

The back of the tank is off center from side to side by about 1/4" also

They had me fill out a form with my info so hopefully they are sending a replacement :) Now I will just have to put up with the 5 year old asking a million times when the tank will arrive :p
