skimmer not outflowing fast enough

I just got the reef octopus bh 1000, I set it up and when I try to start it up the outflow cannot keep up with the inflow. the reason I have come up with is that the intake is too far underwater in my aquarium. I have jacked the intake up as far as possible but I cannot get it to the point in my aquarium so that it is just below the water line. the pipe for the intake is too long for the intake cup so what I want to know is will cutting the pipe fix my problem or not? I do not want to void the warranty on something just to find out its not going to work
 
I cut the intake tube on mine in half. Added an intake tube from an old canister filter, then I added a pre-skimmer box. The box is 8x4x4, should have gone wider but oh well. It works wonderfully with awesome surface skimming :)
There is a little trick to starting them up. First do so without the cup in place and before plugging it in make sure you close off the air intake (priming it) with you finger and hold it until the water levels out then let go. Replace your cup so that the bubbles are at the bottom of the neck.
