I would estimate where his finger is at to be 4 gallons, the top of the bucket is 5 gallons. I have mine measured out in half gallon increments, the mark second from top is four gallons.

I have wondered the same thing about my Lowe's buckets. I figure if it is sold as a five gallon then the very top is exactly that.
