Bought an item but wasn't delivered whose responsible??

Hey fellow reefers..I need some general advise.

I bought a used item on here from the for sale thread, a Rain ATS. Fedex says it was delivered last week but I was working from home and can guarantee it never made it to my door.

I tried contacting them and they said it's basically lost all I can do is file a claim which looks like I Can maybe get 100$ back?

My question is whose responsible myself or the seller, since obviously the item cost more than $100. Part of me says I should just request my money back and let the seller deal with FedEx and the claim because I paid for an item and it never came and it's up to the seller to ensure it gets here or to buy insurance on an expensive item..but the other side is obviously they shipped it so it's not entirely their fault either.
 
imo not the sellers responsibility once it is in transit. id work with the seller let them know and both of you can file a claim. but you both have proof that it was shipped. i would not ask seller for anything in return just my .02cents
 
It is absolutely the sellers responsibility. The seller should have bought insurance. Get with them and ask them if they bought the insurance and see if they can start a claim

The seller has to file a claim with the shipping company for a reason: they are ultimately responsible to get you your item or your money back.
 
I had this happen once. The seller didn't package the item properly and it arrived broken. The seller filed a claim, was paid by the shipping company (?) and kept my money and the claim, presumably. All I got was a damaged, useless item.

I hope this situation turns out better than mine did.

I would agree, but i think it's likely I'll lose the paypal dispute if I open one, since they added the tracking # there and it says "delivered"
 
I've had this issue with an item bought through PayPal. Not on R2R fortunately.
The seller kept telling me I had to deal with USPS. I tried several times and over several weeks. Dealing with the Post Office is a total exercise in futility.
Cutting off my long story here.
Contacted PayPal. I had contracted with the seller to purchase an item and have it delivered to me. The seller then hired a 3rd party to complete the transaction. It is the sellers contract with them where the problem was. My contract with the seller was never fulfilled. Paypal refunded my money so the seller could deal with there contract with USPS.
That being said if FedEx is saying it was delivered in their tracking information this may not work.

If you have correspondence with the seller acknowledging the lost package it maybe helpful.

I'm almost certain fedex and ups have GPS coordinates tied to the delivery scan so they should be able to find out if it was left somewhere else

Yeah they said they did a "Trace" and said would have more info in 48 hrs but never contacted me again. I called back and they said they had done everything they could to find the package but no luck
 
After reading some of these replies I'm getting a camera for my front door for proof. Clearly there is no integrity in shipping companies anymore because IMO they should still investigate. After all how many people would lodge a complaint if something arrived as it should?

Having said that is it possible it went to one of your neighbor's houses by accident or maybe porch pirates? I've been finding lately I'm not getting any delivery notifications so I have no idea the package arrived. I also work from home so know for sure I'm also not getting a knock on the door from the delivery person. Twice I just found my packages on the porch when I went to get my mail. Nothing in the app showing delivered although I think the alert came a day later on one of them. Thank goodness the porch pirates didn't get to them first!


It used to be so exciting to get a package. Now it's just stressful especially if I have to check my porch every 5 minutes.
 
Fedex consistently delivers other peoples packages to my home, I have to call them and make them come back and pick them up, sometimes they sit on my porch for several days before they ”get around” to picking them up and taking them where they belong. :rolleyes:
 
The last time I used fed ex ground I got a notification the item was delivered. 2 hours later, a sketchy suv shows up full of packages, and throws it on my porch. Guess that’s how they are saving costs these days.

I said the same thing (or stolen). Just because it says "delivered" doesn't mean to say it was delivered to the correct address and is worth getting the company to confirm and asking to confirm with GPS info is a great idea.

I've had this happen but fortunately my neighbor brought it to me so I didn't have to go on a search and rescue mission.
 
I constantly have to keep looking outside anytime UPS or FedEx are scheduled to deliver something here. UPS is nice because I can at least track the truck and see when it's close so I can run to my neighbors and get my package (They deliver their stuff to me and my stuff to them but, never get it correct.) If I'm not home and FedEx delivers I have to look around my house and the neighbors.
 
For the future, on expensive items being shipped, there should be insurance on the package, or at least the offer of having the package insured.

If the value of the package exceeds the built in insurance included with the standard delivery, then the shipper should give warning to the buyer that the package should be insured. Either offer the warning that shipping under insured will be the responsibility of the buyer, or give the buyer the option to insure the package at an additional cost.

The seller is responsible if they did not warn the buyer that the method of shipping would not include insurance.

As a seller, you are responsible to get the item to the buyer. If there is a chance that there might be an issue, you need to warn them that it is a possibility and allow them to decide whether to go through the transaction or not. If you are going to offer a cheap shipping option that under insures the package, then this needs to be made known to the buyer. But if the buyer is warned that this is an issue and decides to ship with that method anyway, it is on them.

Everyone loves cheap shipping, but if the cheap method of shipping only includes $100 worth of coverage, and you are shipping something worth $300, then this is an issue that needs to be decided before hand. If nothing is mentioned, then this is poor handling on the part of the seller.
 
UPDATE

was able to get in contact with fedex again, calling them is a nightmare BTW. i literally call and 75% of the time get hung up on somewhere along the way, either before reaching a rep or in the process of being transferred and spend another 5min calling back and going through the robot to get to a actual person.

the good news is that fedex gave me a different answer this time, they said they completed the trace and confirmed they delivered it to the wrong house but when they went back to get it, it was gone. so they said to file a claim, however I can't file one only the shipper can.

the bad news is that since only the shipper can file a claim, im kind of at the shipper's mercy to get any refund, since i wont be in the loop on the claim status.

my last resort would be to paypal dispute, but since the tracking number says delivered i'd have to find someway to connect paypal and fedex so fedex can say they didnt deliver to my address and the "Delivered" status is false.
 
Carrier and id check neighbors as it may have reached wrong house
I love my cameras- id know if truck never came to my house
 
I can only speak for the UK but it is the sellers responsibility to ensure you get the item you paid for, a postal courier is just an extension of the seller, you have basically paid to have an item delivered so it is down to the seller to make sure it is.
