Bought an item but wasn't delivered whose responsible??

I have had a similar experience before. There are many things I would rather do than have to call USPS or Fedex again. IMO - the seller is responsible if the package doesn’t make it to your door. - especially in this instance since the carrier confirmed that it was misdelivered, granted that they never get it back to you. As mentioned above they should have insured the package. The seller assumes responsibility once they decide to ship, which is why many people are hesitant to do so. Did you find the seller here or on another website?
USPS has delivered my package to the wrong house on numerous occasions. I think it would have been easier to knock on every door within a 50 mile radius to get my stuff back.
 
UPDATE

was able to get in contact with fedex again, calling them is a nightmare BTW. i literally call and 75% of the time get hung up on somewhere along the way, either before reaching a rep or in the process of being transferred and spend another 5min calling back and going through the robot to get to a actual person.

the good news is that fedex gave me a different answer this time, they said they completed the trace and confirmed they delivered it to the wrong house but when they went back to get it, it was gone. so they said to file a claim, however I can't file one only the shipper can.

the bad news is that since only the shipper can file a claim, im kind of at the shipper's mercy to get any refund, since i wont be in the loop on the claim status.

my last resort would be to paypal dispute, but since the tracking number says delivered i'd have to find someway to connect paypal and fedex so fedex can say they didnt deliver to my address and the "Delivered" status is false.
Just file a paypal dispute and note in the dispute what fedex told you.

Paypal makes it very clear in their terms that it's the shipper's responsibility to get the item to you - and its the shipper's responsibility to properly insure the item. If the shipper didn't want to risk the package disappearing, it should have been shipped signature required and insured properly.
 
I've had things shipped to me that required a signature and FedEx and ups still just drop them off with no signature.
 
You've probably already confirmed the address since you mentioned Fedex seeing it was delivered to the wrong address but I have seen quite a few times packages (from scammers) being delivered to a house a few blocks away so tracking will say "delivered to *your zip code*". They try to use that loophole to get away with Paypal cases. It's likely an empty box anyway when this happens.

Not saying anyone is a scammer in this transaction but it does happen pretty often. Surely less often with Reefers though!

I have a lot of Paypal experience and when this kind of thing happens, you need to have a Fedex case number that says the address listed on the shipment was not the correct address that you provided to the seller. It's not impossible but very difficult to beat a tracking number that says "delivered". A Fedex case number that refers to Fedex making a mistake is good, but that's not seller fault. In that instance, it will be up to the seller to request reimbursement from Fedex. Your conversation with them about your refund will become a separate issue.

Paypal won't know one way or the other if the seller received reimbursement from Fedex so that's where you have to hope they're an honest person.

As a small business owner that's 100% over the internet I would say it's unlikely you would win the dispute. From personal experience I have noticed various postal services marking things as delivered when it's blatantly not. Larger venues usually just replace the item since they have tax deductions for such problems. You might want to see if they'll send a replacement.

It happens - mostly because of the way drivers are paid.

But it's way easier to win a claim if you paid for insurance and signature required and they didn't get a signature.

I sent my brother a birthday gift from Amazon.com
They sent me a text when it was delivered, with a picture of the package sitting at my brothers front door. I thought that was pretty cool.
 
not the sellers responsibility fedex says it was delivered.

many dispute on delivery is normally the responsibility of the person that actually paid for the service, even is the buyer was charged for postage it’s the sell that physically paid for the service, most companies will only deal with that person.

does PayPal not require a signature for items over a certain amount? (They may have Waived this rule with COVID)

After reading some of these replies I'm getting a camera for my front door for proof. Clearly there is no integrity in shipping companies anymore because IMO they should still investigate. After all how many people would lodge a complaint if something arrived as it should?

Having said that is it possible it went to one of your neighbor's houses by accident or maybe porch pirates? I've been finding lately I'm not getting any delivery notifications so I have no idea the package arrived. I also work from home so know for sure I'm also not getting a knock on the door from the delivery person. Twice I just found my packages on the porch when I went to get my mail. Nothing in the app showing delivered although I think the alert came a day later on one of them. Thank goodness the porch pirates didn't get to them first!


It used to be so exciting to get a package. Now it's just stressful especially if I have to check my porch every 5 minutes.
Agree, when I am home, delivery drivers never knock or ring the doorbell. It’s so frustrating!
