Clause 9B of the contract states that if cost of materials go up over x percentage they can charge us an increased amount.

So a lot of things were material cost went up they were not able to charge us because it wasn't enough of an increase in percentage. However the well was about 3k extra, and the drywall went up significantly. There were a couple other little things here and there. They said we can meet with Bobby on Monday Tuesday or Wednesday to have him show us the invoices, and we responded with actually, we would like for you to email us copies of the relevant invoices instead. (Because we want a paper trail).

We also want to verify that they are in fact only charging material cost, because nowhere in clause 9B does it reference the cost for labor.

And the cost to install a well in our area varies from 3000 to 15000 depending on how deep they end up having to dig it.

This is where the cost of material specifically portion of it comes into play, there was an 8,200 allowance for the installation of the well. But again, the clause in questions specifically states material - Not labor, not procedure... So if we really want to get petty, we absolutely can.

Personally I don't think it's worth it, and I just want to be in the stupid house. But what we are considering doing instead is going out on Sunday and building an extremely detailed punch list. And then sending that extremely detail punch list to a couple other contractors we know, and asking them to ballpark how much it would cost for them to fix all of those things on someone else's build. And then presenting them with all of this information on Tuesday and telling them if they just want to wash their hands of this house and be out of it by the end of the fiscal year they can deduct that cost and we will pay someone else.

Curious to see what excuse they come up with for why they can't send us copies of the invoices. Like we can Amazon prime y'all a little scanner if you need....

Don't forget to take the cost of the scanner off ;)

Did they take longer than they said they would? That would increase the likelihood of materials costs to fluctuate which wouldnt be your fault because they took longer than they said.

I was curious if there's something in that clause that mentions delays due to builder incompetence or something.
 
hehe. lets get the internet involved.
lol ... I do work for a custom home builder and we have a contract and said timeline on that contract. We do not charge for cost fluctuations though. If materials go up, he has to swallow that.

edit to add: not that any of my experience helps. It's all based off the contract.

Yes, but they worded that part to weasel their way out of any liability for taking longer. It's "estimated" or something along those lines. I forget exactly.

also if the delay in them doing the work allowed them to wait and "buy" the items when they were more expensive there may also be an issue there. esp since they have more knowledge of the "market" and may have things they purchased in a warehouse but yet didnt use them until the price increased.

Driveway final inspection happened and passed. Husband took his sister who's in town to see the house and when they were there there was a cleaning lady there. She said the plumbers had been there earlier, Matt did a look around and from what he could see he thinks they got everything fixed that failed the last inspection.

She asked him if he knew what happened to the tub, he told her about how before the drywall was even in the tub was full of water and there was a wrench in it rusting & we let them know the first time we saw that that there was rust in the tub at this point from it being left there in water - they told us that they would handle it later. Still hasn't been handled. In fact, when we walked with one of the superintendents we drew his attention to it again, and he said he has a guy who does a really good job cleaning stuff like that up it'll be fine by the time we do the walkthrough. We said we do not want this painted, that will not be an acceptable solution to cleaning this up - He said not to worry, that wouldn't be what happens.

They're going to be real upset when we do the final walk-through and we say we want that tub replaced because they painted it to "remove the rust"

They also haven't fixed the tile spot that we specifically called out. I don't know why they have a cleaner out there today when there's a ton of stuff that's going to make mess that needs to be fixed still.

Edit: they called for plumbing to be reinspected. Fingers crossed they fixed it all,

I’d say absolutely, because you definitely deserve it.

I’m hoping they get off their ***** and fix things. As a person who’s husband was in remodeling and construction, and ai being his gofur lol, we would have had that list knocked out so fast.
 
Hey I just heard that fl is due for some windy weather. Not sure what part of Florida or how windy but man let me know since I don't do TV. Jic there were fl people I knew. So fyi. Make sure you strap in tight to the broom if you go out this weekend.
