Yep. I could be wrong, but don't see how those could be the same -- the third (( post 16 )) is a Mag, don't see that with the other pictures.

These are the pics that i pulled from his facebook that was listed as the nem that i bought. He had it like the one in post 16 on april 15th and then june 4th is the pic with the clown fish. I just got it the other day. Im not 100% sure nor do i really care, i plan to just try and get it back up to a good solid growth and cross my fingers

This guy has never steared me wrong. He even said i have no idea what it is... Its eather a BTA or a Mag i just got it in and missplaced my order sheet. Paid $50 for it and it came with 2 hosted clowns that had been in it for over a month and he said its never given him any issues. So for all i know it will either stay like that or get better lol But the clowns alone were worth the $50

Idk i got a bad feeling about it... im going to take it back today. Last night it went from open and looking good to hiding under the smallest place it could fit itself and closed up completely. I think its a bta and i dont like the fact that the tentacles are transparent

As mentioned already, this is fairly normal new anemone behavior as they try to adjust to your lights and flow. Welcome to the joys of anemone ownership!
There's a good chance they saw little to no light and maybe just as much water flow between the ocean and your tank....unless he's a captive-bred. I can't say they pull out of it 100% of the time, but it's definitely a good majority IME...maybe even 90% or more. Anemone are tough!
Personally, I'd chalk it up to normal and just be patient and let him find his place in the tank. Check back in if he releases his foot and starts drifting the tank...trying to make a getaway. Something is keeping him unhappy if that happens.
If he's captive bred and doing this, then I might guess something strange is happening...but I think I'd still just give it time.
If you do take him back for exchange, don't be surprised if the next ones goes into the same mode of acclimating to your tank.

I cant tell what that is from those pics. That coral defiantly is bleached and bleached bad. You should care because a E. Magnifica and a E. Quadricolor are very different in levels of care and requirements. Most btas are bullet proof where Mags are harder to keep and require much more flow, lighting and stability and grow much larger. A bleach bta is not to hard to bring back if it is still sticky but a bleach Magnifica is very very hard to bring back.

Thats the thing that worries me... I mean i paid for it i want it right.Its sad that its like this and he has had it in his tank for over a month... Its been this way the entire time he said. That being said i had a bad feeling about buying it, i felt rushed into it, and i want out. I know they like to play hide and go seek with you when you first put them in. Thats okay. But the color is whats driving me to take it back. If its bleached as bad as everyone thinks and my gut told me it was bleached, it needs to go back to his tank and be his problem.

Sounds well thought out to me. It must be said that everything I've seen at LFS, except their display, has been somewhat bleached as their tanks aren't made for long term keeping. However I understand your desire to return it.... $50 is the cheapest non-condy I've seen. Best wishes!

For 25 more i can get a nice RBTA i saw there about the same size. So.... we shall see

You have to do what you think is right. I would call, most places dont take returns but will give credit or just partial credit.
Bleached anemones can be saved if given the proper care and they are at least sticky and not torn.. They need to be sticky because they need to eat or the will continually shrink till they die.. They are basically consuming themselves. I have no idea what your skill level or experience is in the hobby. Bta's are not to bad to bring back but magnificas can be very hard, that one has also lost pigments and even when it gets it's Zooxanthellae back probably wont be as colorful as it used to be or will take a very long time to get its color. Takes longer for the pigments to come back if they ever do than Zooxanthellae if they have lost the pigments too.

If i can get it out of the tank safely im going to. Even if i get partial credit i know at least it will be in the hands of a fish store and not me. I want something that can take a little beating because im not an expert yet.

Hahaha well good news, I walked in with it and he started making fun of me, (he calls me jake from state farm lol) he said i was a scardy cat and i read too much. But im the customer so i make the rules 
Ive been in retail long enough to make sure that when im on the other side of the desk im ruling the roost too. Anyway. He took it back said i was missing out and then asked what i wanted. Getting a nice big 6in wide RBTA for $75
He got it off the rock and tossed it in a seperate tank. I asked him to let it acclimate for a little for me (the nem hasnet moved he said in 6 mo) Then i'll come back. No problems still happy guy and i feel a lot more confident in my purchase. Pics to come soon! Thanks everyone! That was a doosie on my part lol
