Does the transaction show up if it never leaves pending and gets cancelled? I've honestly never watched for this on any of my statements. I can also say I've never been in a situation like this.

I'm usually the one who says "too good to be true" and misses out. Only to find out it was legit and kick myself.
No, if a pending transaction is canceled by the retail outlet, it never shows up on a statement. It can however be pulled from the record upon request or screenshotted for the purposes of the court case. Since I, like you, have never been in that sort of a predicament, I don't know if that would be enough in a court of law.

I was the guy who did the "too good to be true" thing too, I jumped on this one just to see what would happen :-D
 
But THAT is exactly the fear of the acquisitions.

BRS as a sole retail entity can and did do videos for a lot of the retail products they carry because it didn't matter to them which one sold more over the other. Now that there are competing interests (EcoTech Marine, Neptune Apex, AquaIlluminations), Tunze, Sicce, Maxspect, etc compete with EcoTech products, so the jury is out currently if we will get in-depth reviews of their new products (they already haven't covered the Maxspect Jump lights or the Blue Edition soon to be coming out), my speculation is that because they compete directly with AI Prime's at a lower pricepoint, they won't get reviewed, only time will tell though.

Also, did it ever occur to you that the reason Profilux or Hydros don't have more market share is that the internets number one source of information about reef equipment hasn't showcased them? Ryan brings this up in a "History of Controllers" video published a year or two ago where a controller manufacturer was telling him "No one will distribute it if you don't talk about it, they've already told me as much". He even acknowledges in the video that that's a big weight to carry on his shoulders. The simple fact of the matter is, the Reefing Hobby Community, retailers, and distributors as well as consumers, look to BRS for product information and recommendations. If they're recommending based on only products they are affiliated/associated/partnered with, the market share of all other products goes down, leading to less competition in the market.

As for the why aren't others doing deep-dives, there are smaller youtube outlets doing deep-dives of GHL/Profilux and CoralVue/Hydros, they just don't have nearly the viewership of BRS.

BRS has always put out videos on the better sellers. It's how they choose what to test at times. Remember all the salt tests? They only tested the 8 best sellers. Left the rest out. There wasn't time to test every single salt.

We will have to agree to disagree but it's not on BRS to make sure a product succeeds IMO. I fully understand Ryan carries that weight. I've talked to him about directly in the past. It's one reason he won't name some additives they tested.

For BRS to put out GHL and Hydros videos would require someone spending months, possibly a year or more, learning the system. I know for a fact one of them is doing this currently. GHL alone will take 12 months to figure out.
 
The best defense for BRS (unless the UCC or some other authority lets them out of this pickle) i think would be unilateral mistake doctrine, which minnesota law kinda combines with other doctrines of the law.

I don't know how "pending" works exactly. Thus the question. Is the money in escrow? Inaccessible to both sides until the contract is fully complete?
 
I don’t see how it is morally wrong to order this. BRS could easily cancel all of the orders if it was an accident and they would lose no money. It’s not like you are taking advantage of them and they can’t do anything about it, they can very easily keep from getting hurt at all if they want.

This helped me think about it. The issue is not where the money is or whether the money can be returned. The issue is whether there was acceptance.

Charging the card in the first place is acceptance IMO. That's "taking the money" regardless of whether they keep it.

i'd sue them if i was in this boat. Why not? Free for me. lol. At least send them a good (maybe somewhat funny) demand letter.

To keep it would mean they got it though, right? It was in their possession.

If they never got the money, they can't return it. Like if you went to hand them a $20 bill but they refused it after you sat there for 2 days waiting

The act of BRS charging your card is completing the contract IMO. Anything after that is semantics.
 
Fun conversation.

It's a sad world we live in if people really get so upset over this they would actually try to sue.

Again, 51% chance they honor it all and move on.
The real question is if anyone at BRS got fired???? Maybe Ryan made them clean all the office tanks for a month... lol
