You are right it’s a civil matter in this case buf writing a bad check (checks) is a crime.

I know this is not going to ease anyone’s minds but to give more info on what kinda guy he is.......I spoke to Mike O’Brien last week. Mike has offered a sump to me and a tank that was in the boneyard to use in my shop. Mike call me two weeks ago and said he was just informed Ed was closing the. Business and licked him out of the building. Told mike if he came on the property he would be arrested. Mike basically had to get a stand by to get his tools and equipment. Ed owns nothing. I inquired about the sump and tank and mike said he would have Ed contact me as he was trying to unload everything. Ed called me last week and renigged on the original offer but said “I have several other tanks that I will gladly make you a deal on and if you refer anyone that buys a tank, I will give you a cut””. I hope the tanks he is offering are not ones that were being built for people on here and good luck with your recovery!!! ED JENSON DO THE RIGHT THING...refund the money.....oh wait it’s already spent in sure.

I thought I read somewhere it can become a criminal issue when the transaction crosses state lines. Maybe a local attorney would take a free phone call.

Talking with Mike, Ed bought the business and ran it into the ground within 4 months. He did nothing to actually market or help with the production of anything

Have you tried calling your bank to reverse the ACH transfer? Sometimes within 60 days they can do that. No guarantees though.

As I said, in certain instances of fraud, a bank can attempt to reverse an ACH transfer within 60 days. Ideally has to be done within 2-3 days. It’s worth a try. Obviously, if the account has been withdrawn there’s not much that can be done.

It’s a crime/fraud (often wire fraud) to solicit/accept payments for goods or services one doesn’t intend to deliver. Best bet is for everyone with issues to join together and contact the DA’s office in the jurisdiction of the company.

If the company filed for Chapter 11 or another protection, then it may be tougher to recover funds.

This is crazy. I am so lucky to have gotten my sumps from them when I did. I had some custom work done so it took them a while but I bought them from Julian. In case anyone is reading this later, Julian started and ran CRA until this summer. He is a good, respectable man who has nothing to do with this mess that happened after he sold to Ed.

Actually Julian sold his local pet shop "Bellingham Pet Supply" the year before and I am told he misrepresented the business to the buyer (and she didn't get his tax returns... what are people thinking?). Anyhow, I wouldn't be surprised if something similar happened here.

Hind sight is always 20/20, and of course I regret having paid through their invoicing system, but I had met the master builder, Mike, at their booth at RAP Anaheim, and talked with him for an extended time planning this build. I also obtained quotes from 10 additional builders, and CRA was the one that I felt best with as they were very responsive, called me to discuss the build, and really seemed to be on the ball, and, this is very important, they are an R2R sponsor so I felt I could trust them. Of course I have now learned a crappy lesson, but I can only hope that Ed will do the right thing here.

A judgment attaches to his house, so if he ever tried to sell or refi, he would have to pay the judgement first or at closing.
