A judgment attaches to his house, so if he ever tried to sell or refi, he would have to pay the judgement first or at closing.

it’s not always as easy as that. and like i pointed out - someone like this probably doesn’t have any assets.

Liens can be assesd pretty easily and assuming one has no assets is silly IMO. It's at least worth a try since this guy seemingly has taken money from others.

nope. liens are not always easy at all!!! it depends on what type of asset we’re talking about at the jurisdiction the asset is located in. someone who is this blatantly irresponsible in regards to liability, is probably that way because they have nothing to protect. i studied laws (civil, criminal and commercial) as part of my ba in law enforcement. and i worked in the profession. i often worked with sheriff’s departments to attach liens in certain situations. so with professional experience, i can state - it’s not always simple, or worth the time/money.

not saying it’s not worth suing to get a judgement. but what good is a judgement without any return?

i’ll also had to serve people papers. their reaction pretty sums up how things are going to go.

I'm sure jurisdiction has a lot to do with it. In florida the company I work for has liens for a 500 dollar bill on million dollar homes. My point is why assume someone's assets by their actions, no logic to me. Even if you don't get anything in return it's still worth it to me if it means that person can't sell his house.

As a former Title Agent for Real Estate closings, I can assure you that a properly recorded lien will attach to his house. I know that he owns a house, so if nothing else, I will definitely file suit in small claims court and have the judgment recorded properly so that it does attach to his house. It's really a very simple process. I actually have an email from him stating that he knows he would lose a suit in small claims court and has no defense.

I sent them an email and asked them to refund your money and to respond to these issues. Hopefully they will do the right thing.

Thanks for posting all of this its a good learning lesson Reefers but I'm sorry anybody has to go threw this

I got the standard "I'll refund your money" last night. Time will tell....

I paid over two months ago and my tank was nearly complete as of the start of October. Granted, I'm not in for $5500 but I am in for $1650 which is no small sum for someone in their 20s. Ed said he'd be shipping my tank next weekend, so I'm really hoping he's able to follow through.

I really hope he comes through for you but mine was done except for eurobracing and was supposed to ship 3 weeks ago....

Thank you all very much for the support, and especially @revhtree as I'm sure you're contacting him had something to do with this... I GOT MY MONEY BACK TODAY!!!

I had it for a very short time, as it went out (via credit card this time) to Miracles who will now be building the tank and stand for me, and I will be going with a custom sump from Bashsea.

Thank you Ed for doing the right thing.

Bill,

No Problem. We have and continue to work with all our customers to ensure their products are finished or they are refunded as appropriate. That has been our message all along and has never wavered.

Rev,

Thanks for the email, but I do want folks to understand when we said we would refund folks their money, we meant that. Your email didn't encourage or discourage from doing what we were already going to do. I have felt very strongly around this.

I know this is old, but I was caught right in the worst time time to make a purchase. Well my tank was delivered right before the end, the overflow I bought with it is completely faulty.

All I have been asking for is complete drawings of my tank so I can have another company build me an over flow that works without having to break down my plumbing to take measurements.

Ed was responsive in January, and wanted to send me a new one, but it’s been radio silence for months.

At this point I just want complete drawings. If anyone knows how to reach Ed or Mike, I would greatly appreciate it.
